The candidate who is interested to work in Canada should need a work permit. The following steps will help you in getting a Canadian Work Permit.

Apply for a Work Permit

Applying for a Canadian Work Permit is a two step process. First of all, the candidate should possess a job offer from an employer in Canada.

Step one

LMIA and ESDC play a major role in obtaining a Canadian Work Permit. LMIA is Labour Market Impact Assessment and ESDC is Employment and Social Development Canada.

The first step is to apply for LMIA from ESDC. The employer should make it clear that there is no suitable Canadian citizen for the post during the recruitment at hand.

Step two

After receiving LMIA, the candidate can apply for the work permit in Canada. Work permits are usually employer specific. The worker might have an open work permit. If the candidate wants to change the job or employer, he should get a new work permit. These work permits are limited in time. LMIA takes care of the work permit process of the Canadian as well as the temporary workers from other countries.

The immigrants select their choice of suitable province from the list and then apply for permanent residential status in Canada.

Duration of the Work Permit

The Canadian Work Permit has an expiry or end date. When the end date comes, the candidate has to leave Canada for a specific time. The government has put on a limitation to the length of the Canadian work permits.

The worker can work consecutively for 48 months or 4 years in Canada using the work permit. After the specified date, the work permit gets expired. The worker has to leave the job as well as Canada. The worker has to stay away from Canada for the next 48 months or 4 years. Then he can join again with new work permit. Thus, the maximum working years in Canada is only 4 years.

So, there is only one way to work in Canada continuously, is to get a permanent resident status.

Open Work Permits

There is one more type of work permit called Open work Permit. It differs from the regular work permit. The job and employer of the worker are indicated in the regular work permit. But the Open work permit gives liberty to the worker not to stick with the particular employer and job. The worker who holds the Open Work Permit can work for any Canadian employer.

It does not require a job offer letter of the applicant as Labour Market Impact Assessment (LMIA) usually does.

According to NOC- National Occupation Classification, the Open Work Permit of Canada is also applied for

  • The spouses or family members of the temporary foreign workers at skilled levels 0, A and B.
  • The spouses and family members of foreign students who are engaged in full time study.
  • The International students graduated from the Post Secondary Canadian Institutions.

Exemptions of Canadian Work Permit

There are some exemptions in Canadian Work Permit as,

  • Foreign representatives and the family members of the foreign representatives.
  • Sportspersons as Athletes, team members and all players from other countries.
  • Artists and performers.
  • Mass media, press and reporters.
  • Organizers and business visitors.
  • Clergy, judges, referees and such officials.
  • Examiners, evaluators, foreign government officers, civil aviation inspectors, transportation crew, Military personnel.
  • Investigators, witnesses, aviation accident inspector, on-campus employment and health care students.
